Abstract

The research analyzes the relationship between formal legal frameworks and informal political processes during the establishment of new local self-government units. In the process of forming new municipalities, even after the citizens' initiative has been implemented and all legal requirements have been met, in practice, political influence often appears as a significant obstacle. At the same time, political support in certain cases can act as a strong incentive factor, enabling citizens' initiatives for the establishment of new municipalities to be rapidly implemented through the legal system. The goal of the research is to determine whether and to what extent political support, or its absence, affects the process of establishing new municipalities. A special focus is placed on the question of whether this is one of the key factors that determine the duration of the process of realization of citizens' will, as well as whether this will will be realized at all. Answers to the above questions will be offered through the analysis of two case studies, namely the municipality of Ankaran in Slovenia and the municipality of Stanari in Bosnia and Herzegovina. In addition to the mentioned method of gathering data, for the purposes of research, methods of analysis (content) of documents were used, as well as a comparative method.
