Abstract

The institution of public notary is an important segment of the modern legal system and the legal security of citizens. Notaries public have an important role in the circulation of rights, protection of legal circulation and preventive action in order to prevent court disputes. Modern public notary systems differ in terms of organization, jurisdiction and legal status of notaries, but most European countries accept a public notary model based on the continental legal tradition. The aim of the paper is to analyze the legal position of public notaries through a comparative presentation of solutions in the Republic of Serbia, Germany, France, Italy and the United States of America. Special attention is paid to the public legal function of the notary, the relationship with the courts and the legal profession, as well as the importance of the notary service for legal security and the efficiency of the judiciary.
